U.S. Staatsbürgerschaft ohne Kontakt zum Vater?
Hallo,
Ich frage mich gerade, ob mir die U.S. Staatsbürgerschaft zusteht und bin nach längeren Recherchen nicht ganz sicher.
Situation ist folgende:
Ich bin das Kind einer deutschen Mutter und eines amerikanischen Vaters, welcher aber von Geburt an keinen Kontakt zu uns haben wollte. Ich habe ihn nie kennengelernt, weiß nicht genau wo er wohnt, habe nie Unterhalt erhalten.
Jetzt frage ich mich, ob ich die U.S. Staatsbürgerschaft erhalten könnte.
Eine Vaterschaftsanerkennung und eine schriftliche Unterhaltsverpflichtung, die er unter Eid unterschrieben hat, liegen mir vor.
Außerdem unterschriebt er darin, dass er U.S. Staatsbürger ist.
In meiner Geburtsurkunde steht er aber nicht drin.
Das Internet sagt zum einen, dass das genügt, auf anderen Seiten aber finde ich die Aussage, dass ich im engen Kontakt zu ihm stehen muss und er vorweisen muss, wann er wo gelebt hat etc.
Weiß vielleicht einer hier genaueres, bevor ich mir die Mühe mache und die ganzen Dokumente übersetzten lasse?

A person born abroad out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) of the INA, as made applicable by the “new” Section 309(a) of the INA provided:
- A blood relationship between the person and the father is established by clear and convincing evidence;
- The father had the nationality of the United States at the time of the person’s birth;
- The father was physically present in the United States or its outlying possessions prior to the child’s birth for five years, at least two of which were after reaching the age of 14.
- The father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years, and
- While the person is under the age of 18 years --
- the person is legitimated under the law of his/her residence or domicile,
- the father acknowledges paternity of the person in writing under oath, or
- the paternity of the person is established by adjudication of a competent court.
Birth Abroad Out-of-Wedlock to a U.S. Citizen Father – “Old” Section 309(a) of the INA- A child born out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under the former Section 301(a)(7) of the INA as made applicable by the “old” Section 309(a) of the INA if the U.S. citizen father, prior to the child’s birth, had been physically present in the United States or one of its outlying possessions for ten years, five of which were after the age of 14, and if the paternity of the child had been established by legitimation prior to the child reaching the age of 21. The “old” Section 309(a) of the INA is applicable to individuals who were 18 on November 14, 1986 and to individuals whose paternity had been established by legitimation prior to that date. Individuals who were at least 15 on November 14, 1986, but under the age of 18, could opt to have their claim determined in accordance with the provisions of either the “old” or the “new” Section 309(a).

Ich gehe mal davon aus, dass du sie von Geburt an hast, siehe deine vorherigen Fragen und die Links von @frodobeutlin100.
Bitte beachte aber, dass BEVOR du die US Citizenship tatsächlich beantragst, dass du eine Beibehaltungsgenehmigung für die deutsche benötigst.
Lässt du dir die Erlaubnis auf die doppelte Staatsbürgerschaft nicht vorher genehmigen, verlierst du automatisch die deutsche. Das heißt du bräuchtest dann, um in Deutschland zu leben entweder eine Aufenthaltserlaubnis oder ein Visum.
Gilt das nicht nur, wenn ich die US Staatsbürgerschaft im Laufe meines Lebens erwerbe?
Wenn ich sie aber von Geburt an habe, braucht man das nicht. So habe ich es verstanden.
Das könnte tatsächlich in deinem Fall so sein. Ein Gedanke ist es trotzdem wert, damit nichts schief läuft.
Ja, das sollte eigentlich gehen.
Ich habe zwar kein Erfahrung damit, aber es gibt einen Deutsch-Amerikanischen Fußballer, bei dem war das ähnlich.Terrence Boyd, glaube ich.Könnte aber auch jemand anderes gewesen sein.Der hat seinen Vater auch nie gekannt.Den US-Pass hat er trotzdem bekommen.

Danke, das habe ich natürlich auch alles gefunden. Ich habe ja grundsätzlich -so glaube ich- das Recht auf eine Staatsbürgerschaft. Mein Vater ist ja aber nicht erreichbar. Somit kann sein Aufenthalt vor meinem 14. LJ in den USA nicht bewiesen werden. Oder?
